The courts can order an evaluation of the mental state of the accused if they have reasonable grounds to believe that proof of their mental state is needed to determine whether the accused is fit to stand trial, or to decide if their mental sate is such that they cannot criminally responsible at the time (Code criminel, L.R.C. 1985, art. 672.11).
