Mission
Criminologists mandated by the Institut national de psychiatrie légale Philippe-Pinel will intervene at the Québec Court, Criminal and Penal Division (C.Q.C.C.P.)—and Montréal municipal court in the context of a Tribunal de santé mentale—for adult clients who are accused and detained and are believed to have a mental-health disorder.
This intervention takes place following a request from deputy public prosecutors, defence lawyers, or judges.
Type of Services
This professional consulting service helps the courts in their clinical and legal orientation of accused individuals. The criminologist makes recommendations to support the proposed guidelines, and can also be called as an expert witness.
The criminologist’s intervention includes a summary evaluation of the individual’s clinical condition, social situation, and therapeutic needs, as well as an estimate of the risk of relapse and violence.
The evaluation can also include:
- An interview with the family or any other key person who can help with the evaluation;
Liaison with professional services as well as specialized lodging at a facility’s that’s involved in the care of the accused individual or who can come to their aid.
Goals:
- Ensure legal representatives understand the situation of the individual with a mental disorder as well as the support network they’re going to;
Support the prosecutor and lawyers when decision making for their client;
Avoid pre-trial custody for those requiring clinical help;
Improve links between the justice and penal systems, healthcare services, social services, community resources, and the individual’s natural environment.
